Can no longer post (Bullion, Coins or Banknotes) out of Australia ?
What is going on ?
If someone can please explain to me how the Australian Consitution works I would be most appricative. I don’t understand how we have a fiat currency inplace when Section 115 states that legal tender can only be Gold and Silver ?

Great Point, so Sec …
Great Point, so Sec. 51 (xii.) Currency, coinage, and legal tender: (Do you think this includes the power to create a Fiat currency then ?)
Thanks, I will keep …
Thanks, I will keep posting as I do.
Just my 2 cents …
Just my 2 cents worth: re section 115 – perhaps the key word to note is “States” meaning that currency must be FEDERAL issue – ie. its an issue of “sovereignty” of the currency, not an issue of bullion V FIAT (ie perhaps you’ve focussed on the wrong aspect of that Section 115).
Anyway – good job following it up and by all means take it as far as u can- its important on so many levels. Perhaps contact some civil liberties group to advocate the cause.
We need people like …
We need people like your self to highlight the fact that every part of our every day life is starting to be effected. I feel this is connected in some way to whats going on in the world ( Not the main stream media version). Please push this as far as possible. The Constitution over rides state & legistative laws. You will find that this leads back to the federal government in which the motivation will not be clearly understood.
if the government …
if the government isnt going to play by the rules and keeps on changing the goal posts. you shouldn’t feel obliged to either.
Section 115,is all …
Section 115,is all about handing power from the states to the new commonwealth. This was wriityen when Australia was just an idea. The states were just colonies with their own armies and navies etc. The important part was the bit about states not minting their own money. This was to make sure that we had one currency in Aus and not a seperate one for each state. It is a limitation on the power of the states not the cth.Sec 51 (xii) gives the Cth broad power to make currency 51(xiii) 51(v) notes

First your guns, and now this…
Wonder how this affects the numismatic hobby/industry?
It makes me sick to see yet another constitutional government (besides the US) ignore its own rules to the detriment of its citizens. Mebbe you folks need to mount a march on your capitol. =’[.]‘=
Yeah I’m starting …
Yeah I’m starting to think a new multi-country fiat currency is becoming more likely every day.
Australia accepts ( …
Australia accepts (bullion, coins and notes) they just no longer alow it to leave the country. Most countries are already doing the same, as others have meantioned I will phone around some other places such as Toll and see what they say.
I saw some american …
I saw some american indian style jewelery for sale in the US that was made by incorporating old silver coinage, i wonder if that would still be allowed through. Perhaps it’s just Australia post that’s blocking the movement of precious metal for insurance reasons, customs would most likely be the best people to speak to about this?, or perhaps have the package labeled ‘metal samples’ rather than coins or bullion?
according to the …
according to the commonwealth of australia it was $20-the highest when the gold standard was in place still its very difficult to ascertain the face value of it too. its now currently $2. not to sure if it was perth coin, im guessing it was
Very good, I didn’t …
Very good, I didn’t know there was a $20 legal tender coin ? I know of the $5, $10, and $200 or are you talking of the Perth Mint Bullion Coins ? Or is this a pre-decimal thing ?

You are talking about in America then ?
sure thing mate, im …
sure thing mate, im 100% confident i can get out of this. My mate had $20,000 worth of fines-red light, speeding and parking and due to this one law alone in which the highest denomination is $20 coin, he Settled it for $20 ROFLMAO
Please let me know …
Please let me know how you go, I have been very interested in this since finding out some constitutional lawyers got out of their fines.
I’ve been getting …
I’ve been getting silver from America just fine, it’s not a great amount but since march I’ve been getting between 4 – 9 silver eagles a month sent from America.
I have noticed that I only get 3 or 4 in a package thou, for instance the months I get 9 I get sent 3 lots of 3.
Gee, governments …
Gee, governments don’t acknowledge that gold and silver are money, and they are relics, yet the post will not allow you to send them out of the country.
End-game approacheth??
damn right its a …
right its a restriction on your rights, but what can u do when we live in a invisible communist society….
ya nobody follows …
ya nobody follows the constituion, these days! i got a red light camera fine the other week, and according to the currency act 1965, all debts must be paid in bullion-gold and silver. there is no gold standard since 1971 so i sent a letter back to civiv compliance stating how i shall pay coz they want $234 in currency thus breaching the constittion. btw im not paying the fine its unconstitional for many reasons other than the currency act
The constitution is …
The constitution is a pact and the private man is not a party to it. I don’t understand why people keep looking to constituation’s of the world for the answers. All Gov. are de facto gov. and have no real authority only the authority you consent too.
I’m sure if you research you Codes/statutes it covers the issue of lawful “money” and legal “money.”
Also, do you guy have something other than a postal service ie. ups, fedex etc…they might not have the same restrictions. Peace
I just went to The …
I just went to The Perth Mint web site and placed an order to have 1,000 ozs of silver mailed to the US (did not complete the order though). The laws in Australia (restrictions on liberty) only apply to the “lowly citizens” of the country. The laws of Australia obviously do not apply to the government of Australia. The government is above the law. Welcome to our nitmare Tozak1.

thanks, I did not realise the Australian Constitution nominated G & S.
Don’t bother …
Don’t bother questioning LAW mate, just work around it.
I have had some fairly serious goes at the law in my time and all I ever learned was this.
LAW COME DOWN TO ONE SENTENCE.
The differing shades of interpretation applied to “LAW X” at the time, by who ever is reading it at the time.
